1. Scope of Work

The scope of work for each project is outlined in the initial project proposal or quote. This scope includes specific design elements, functionalities, and timelines based on client requirements. Any additional requests beyond the defined scope may be subject to additional fees, which will be communicated before proceeding.

2. Client Responsibilities

  • Content Submission: Clients are responsible for providing accurate and complete content for their websites unless otherwise agreed. If content is not provided, AI-generated content may be used; however, please note that we do not offer dedicated copywriting services.
  • Website Maintenance: For clients who purchase maintenance services, we will perform regular updates and backups. However, should issues arise during maintenance due to plugin or platform updates, troubleshooting may be required, which may incur additional charges.

3. Revision Policy

Our packages include a set number of revision rounds to ensure your vision is achieved while respecting project boundaries. The revision limits by package are as follows:

  • New Website Package: Includes 3 revisions (1 major and 2 minor).
  • Website Revamp Package: Includes 2 revisions (1 major and 1 minor).
  • Maintenance Packages: Covers 1 minor revision only.

Revisions are categorized as follows:

  • Minor Revisions: Small adjustments such as text edits, small design tweaks, or color changes (e.g., font style adjustments or image swaps).
  • Major Revisions: Substantial updates, such as altering the layout, adding or removing sections, or changes impacting the overall design structure or functionality.

Additional revisions beyond the included rounds may incur extra charges, with fees communicated and agreed upon before further work.

4. Timeline and Delays

Estimated project timelines are provided in your proposal. Timely cooperation from both sides is essential to meet these deadlines. Client Responsibilities include providing all necessary content, approvals, and feedback as requested. Delays in providing these items may lead to adjusted timelines or additional fees to accommodate schedule changes. We will communicate any adjustments promptly to maintain transparency.

5. Third-Party Tools and Services

Our services may incorporate third-party tools, plugins, or integrations, such as those offered by WordPress or other providers. While we take care in selecting and implementing these tools, we are not responsible for any issues, limitations, or updates that may arise from these third-party services. Clients are advised to review the terms of these third-party providers, as their policies may impact the project over time.

6. Support Post-Project Completion

Each package includes a defined period of post-launch support to assist with minor adjustments or technical questions. The duration and scope of this support are specified in your project proposal. For ongoing support beyond this period, extended maintenance and support packages are available for purchase. These agreements ensure continued assistance with any minor updates or troubleshooting that may be required after launch.

7. Privacy and Data Collection

We take your privacy seriously and collect only the necessary data required for communication, marketing, and service delivery. By using our contact form, you consent to us collecting your name, telephone number, and email address.
We also send newsletters and promotional material. By opting into our services, you consent to receiving such communications. You may unsubscribe at any time by following the link provided in the newsletter.

8. Analytics and Tracking

We use digital analytics software to monitor and improve our website performance. Tracking technologies used on our site include cookies, local storage, and session storage. These technologies help us understand user interactions, customize your experience, and serve targeted advertising, such as Facebook ads.

9. Pricing and Quotes

Any pricing provided through our Quick Quote tool is an estimate only and may vary based on the final scope of work discussed during consultation. All pricing is subject to change. A final, detailed quote will be provided after the consultation, which will take into account all specific requirements and preferences.

10. Payments

Payments for our services are due according to the payment schedule outlined in the final quote. We reserve the right to suspend or terminate services if payments are not received on time.

11. Refund Policy

Refunds are handled on a case-by-case basis. Typically, deposits are non-refundable once work has commenced. Should you request to terminate a project, refunds, if applicable, will be prorated based on the stage of project completion. For more details, please refer to our full Refund Policy here.

12. Hosting and Domain Registration

Value WordPress Designs does not provide hosting or domain registration services. However, we will assist clients in setting up their hosting and domain services through third-party providers as needed. We are not responsible for any issues related to third-party hosting or domain providers, including service interruptions or platform limitations.

13. Data Backup and Security

We strongly recommend clients maintain backups of their website content and data. While maintenance agreements may include backup services, the ultimate responsibility for maintaining current and secure backups rests with the client. For security, clients should ensure regular backups and secure storage of any important data associated with their website.

14. Intellectual Property

All content, designs, and materials created by Value WordPress Designs remain our intellectual property until the project is paid for in full. Upon full payment, ownership of the completed work is transferred to the client. Any unauthorized use of our intellectual property is strictly prohibited.

15. Indemnity Clause

Clients are responsible for ensuring that all content provided for their website, including text, images, and other materials, complies with applicable laws and does not infringe upon third-party rights. By submitting content, you agree to indemnify Value WordPress Designs from any legal issues or liabilities that may arise from the use of this content.

16. AI-Generated Content

If AI-generated content is used due to a lack of provided content from the client, Value WordPress Designs is not responsible for the accuracy, uniqueness, or compliance of this content with applicable copyright laws. We recommend clients review all content prior to launch and ensure it aligns with their brand and messaging.

17. Termination

Either party may terminate the agreement at any time. If the client terminates the agreement before project completion, the deposit will not be refunded. If Value WordPress Designs terminates the agreement due to non-payment or breach of terms, all work completed up to that point will be invoiced.

18. Liability

Value WordPress Designs will not be held liable for any indirect, incidental, or consequential damages arising from the use of our services, website, or any third-party tools we integrate with your website, including but not limited to hosting providers, plugins, or payment gateways.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from the use of our services shall be subject to the jurisdiction of the courts in Cape Town.

20. Force Majeure

Value WordPress Designs shall not be held liable for delays or failure to perform any obligations under these Terms due to events beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, government actions, strikes, or any other event that makes it impossible or impractical to complete the project. If such an event occurs, both parties will communicate promptly and work together to establish an adjusted timeline or alternative solutions where feasible.

21. Changes to Terms

We reserve the right to amend these Terms and Conditions at any time. Your continued use of our services and website after any changes indicates your acceptance of the updated terms.
